These terms and conditions of use (“Terms of Use”) of the Chennai Fresh website and Meat app, is a legal agreement (“Agreement”) between Chennai Fresh Services Pvt. Ltd. (“Chennai Fresh Services”), No 271 Avvai Shanmugam Salai, Gopalapuram, Chennai 600086. If you continue to browse the website and/or use the mobile application you are agreeing to comply with and be bound by these Terms of Use.

If you do not agree with the Terms of Use, please do not access and use this Website / Application or our Service through any other means.

1. Definitions

• “Chennai Fresh”, “we”, “our” and “us” shall mean Chennai Fresh Services;
• “You”, yourself / yourselves and “your” shall mean a User who meets the eligibility criteria set out below;
• “Application” shall mean the application supplied by Chennai Fresh and downloaded and installed by you on your mobile device;
• “Force Majeure” shall have the meaning as set out below;
• “Service” or “Services” shall mean the services offered via the Application/Website;
• “User” shall have the meaning as set out below;
• “Website” shall mean www.chennaifresh.in.

These Terms of Use may be modified from time to time in our sole discretion. It is your responsibility to review these Terms periodically. Continued use of the Service after notice of change has been published constitutes consent to the changed terms.

2. Services Description

Chennai Fresh Services Private Limited operates a technology-based electronic platform service called “Chennai Fresh” which provides food and related products on demand to customers. Chennai Fresh enables ordering of chicken, mutton, seafood and other fresh products through the Application and Website.

Towards the end of the order, customers are charged for the products. Payments may be made in cash on delivery or through online payment options. Chennai Fresh remits any applicable tax to the credit of the respective Governments and regularly files periodic returns as prescribed under the GST laws.

3. Use of Service, Application and Website

The Application and Website allow you to send a request for service. Chennai Fresh has sole and complete discretion to accept or reject each request. If Chennai Fresh accepts a request, the Application/Website notifies you and provides information regarding the order.

4. User Eligibility and Agreement

User means any individual or business entity/organization that legally operates in India and uses our Services. Users must be at least 18 years of age. Chennai Fresh may, in its sole discretion, refuse the Service to anyone at any time.

5. Registration

To use the Services, you must be registered and provide your name, contact number, email address and other details. Please see our Privacy Policy for how your personal information would be used.

6. Representations and Warranties

As a precondition to your use of the Services, you represent and warrant that:

• The information you provide to Chennai Fresh is accurate and complete.
• You will only access the Service using authorized means and a compatible device.
• You are responsible for any liability resulting from misuse of the Service.
• You authorize us to use, store or otherwise process your sensitive personal data in order to provide the Services to you, in compliance with applicable law.
• You will obey all applicable laws and will be solely responsible for any violations of the same.

7. Cancellation Policy

Cancellation policies are described on the Return & Cancellation Policy page. Chennai Fresh reserves the right to cancel orders where stock is unavailable, address details are incomplete, or in cases of suspected fraud.

8. Payment

When an order is placed, the total amount due appears on the Chennai Fresh app on your mobile device. You may pay the amount via cash on delivery or via online payment options available on the app. Any payment-related issue, except when due to an error or fault in the Site or Application, shall be resolved between you and the payment processor. Chennai Fresh shall not be responsible for any unauthorized use of your Wallet.

9. Limitation of Liability

The information, recommendations and/or Services provided to you on or through the Website/Application are for general information purposes only and do not constitute advice. Chennai Fresh will take reasonable steps to keep the Website/Application and its contents correct and up to date but does not guarantee that the contents are free of errors, defects, malware and viruses.

Chennai Fresh shall not be liable for any damages resulting from the use of, or inability to use, the Website/Application. Insofar as allowed under applicable law, Chennai Fresh's aggregate liability shall in no event exceed the equivalent of the amount paid for the Services.

10. Intellectual Property Rights

All content on this Website/Application, including text, graphics, logos, images, audio clips and software is the property of Chennai Fresh or its content suppliers and is protected by Indian and international copyright laws.

11. User Accounts, Offers and Promotions

Chennai Fresh may, from time to time, offer promotional offers and discounts. Each offer is subject to specific terms and may be withdrawn or modified without notice. Misuse of any promotion may result in account suspension.

12. Links to Third-Party Sites

The Website/Application may contain links to third-party websites. Chennai Fresh is not responsible for the availability or content of those external sites.

13. Termination

Chennai Fresh reserves the right to terminate or suspend your account at its sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.

14. Insurance and Damage to Property

Chennai Fresh is not liable for any damage to your property arising from the use of the Services, except where such damage is directly caused by our negligence.

15. Indemnity

You agree to indemnify and hold harmless Chennai Fresh, its officers, employees and partners from any claim or demand arising out of your use of the Service or your violation of these Terms.

16. Miscellaneous

If any provision of these Terms is held to be invalid, the remaining provisions shall continue in full force. Failure to enforce any right under these Terms shall not constitute a waiver of that right.

17. Jurisdiction

These Terms are governed by the laws of India. Any dispute arising shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.

Chennai Fresh Wallet

Overview

Chennai Fresh Wallet is a prepaid payment instrument that allows customers to load money in advance and use it for purchases on the Chennai Fresh platform. Use of the Wallet is subject to applicable RBI guidelines and these Terms.

Terms of the Wallet Service

• The Wallet may be used solely for purchases on the Chennai Fresh platform.
• The Wallet balance is non-transferable and non-refundable to a bank account.
• Chennai Fresh reserves the right to suspend or close any Wallet found to be misused.
• Any unused Wallet balance may expire after the period specified at the time of loading.

Definitions

“Wallet” refers to the prepaid balance maintained against your Chennai Fresh account. “Customer” refers to a registered user of the platform. “Transaction” refers to any debit or credit on the Wallet.
